1. Agreement and operator

These Terms form an agreement between you and LESRUN, a mobile fitness and community service operated from Nairobi, Kenya and identified by the same developer name in its official app-store listing. By creating an account, selecting “Continue,” or using LESRUN, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use LESRUN.

2. Adult eligibility

You must be at least 18 years old and legally able to enter this agreement. LESRUN is not designed for children. You may not create or operate an account for a child or allow a child to use your account. We may request reasonable age or account verification and may close an ineligible account.

3. Your account

Provide accurate information, maintain control of the email and device used to sign in, and notify safety@lesrun.com of suspected compromise. You are responsible for activity through your account unless caused by LESRUN’s breach of a duty that cannot lawfully be excluded. One person may not operate multiple accounts to manipulate rankings, clubs, referrals, rewards, or enforcement.

LESRUN may send service, security, legal, or account notices needed to operate the service. Marketing messages, if introduced, will require the choices mandated by applicable law.

4. What LESRUN provides

LESRUN provides tools to record outdoor activity, calculate estimated metrics, participate in clubs and squads, earn virtual progress, and appear in rankings. Features may be experimental, unavailable in some locations or devices, changed, suspended, or discontinued. LESRUN does not promise uninterrupted service, permanent rankings, a particular club, or successful verification of every activity.

5. Health, outdoor, and emergency safety

• LESRUN is not medical advice, a medical device, an emergency service, or a substitute for professional care.
• Consult a qualified professional before exercise when you have a health concern, injury, are pregnant, or have been advised to restrict activity.
• Choose lawful, familiar, and reasonably safe routes. Obey traffic laws, weather alerts, event rules, curfews, and land-access restrictions.
• Remain aware of vehicles, people, animals, terrain, weather, and your device. Do not look at the screen while moving where doing so is unsafe.
• Stop immediately if you feel unwell or conditions become unsafe. Contact local emergency services—not LESRUN—in an emergency.

Running, walking, meeting other users, and joining club events involve risks including collision, falls, overexertion, crime, weather exposure, property damage, serious injury, or death. You voluntarily choose whether and how to participate and accept ordinary risks inherent in those choices, subject to rights that law does not allow you to waive.

6. Virtual territory, points, badges, and rewards

Territory, sectors, XP, streaks, badges, ranks, and similar items are virtual service features. They do not grant ownership, possession, access, tenancy, security, or any other right in real land or property. They have no guaranteed cash value, are not transferable unless LESRUN expressly allows it, and may be corrected, revoked, reset, or rebalanced to address errors, seasons, abuse, or service changes.

Any prize, paid competition, sponsored challenge, or promotion will require separate official rules before entry. The absence of separate official rules means no prize is promised.

7. Activity verification and fair competition

Submit only your own genuine activity. Do not fabricate or replay routes, spoof GPS, use a vehicle, attach a device to another person or machine, alter timestamps, automate interactions, share accounts, exploit bugs, or coordinate manipulation. LESRUN may automatically verify, reject, hold, recalculate, or remove activity and associated virtual progress.

Automated systems can be wrong. You may request review at safety@lesrun.com. LESRUN may preserve relevant evidence while an appeal, safety matter, or legal claim is active.

8. Clubs, group runs, and other users

Unless LESRUN explicitly states otherwise, clubs, captains, administrators, scheduled runs, meet points, and user-organised events are created or managed by users—not employees, agents, guides, healthcare providers, or security personnel of LESRUN. LESRUN does not guarantee identity, qualifications, background, route safety, attendance, supervision, or conduct.

Use judgment before meeting anyone, prefer public locations, tell a trusted person your plans, and do not rely on LESRUN for live monitoring. Club roles are app permissions, not professional certifications or authority over participants.

9. Acceptable use and prohibited conduct

You must comply with law and respect other users. You may not:

• harass, threaten, stalk, discriminate against, sexually exploit, impersonate, defraud, or endanger another person;
• publish another person’s precise location, private contact details, health information, or confidential information without authority;
• promote violence, illegal access, trespass, dangerous routes, hate, scams, spam, malware, or unlawful goods or services;
• circumvent access controls, probe or disrupt systems, scrape at scale, reverse engineer where prohibited, or misuse reports and invitations;
• infringe intellectual-property, privacy, publicity, or other rights; or
• help another person do any prohibited act.

10. Your content and permissions

You keep ownership of content you lawfully create. You give LESRUN a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, and transmit that content only as reasonably necessary to operate, secure, improve, and promote the LESRUN service according to your settings. This licence ends when content is deleted, except for cached copies, legal retention, content legitimately shared with others, or de-identified material.

You represent that you have the rights needed to submit content and that it complies with these Terms. Feedback about LESRUN may be used without restriction or payment, provided it does not identify you publicly without permission.

11. LESRUN rights and licence to you

LESRUN and its licensors own the app, software, visual design, trademarks, databases, and service content other than user content. Subject to these Terms, LESRUN grants you a limited, personal, revocable, non-exclusive, non-transferable licence to use the app for its intended non-commercial purpose. No other rights are granted.

12. Moderation, suspension, and termination

LESRUN may investigate reports; limit discovery, content, invitations, or activity; remove content; reverse virtual progress; or suspend or terminate accounts when reasonably necessary to protect safety, fairness, legal compliance, or service integrity. Where appropriate, we will consider severity, evidence, repeat behaviour, and available appeals. Immediate action may be taken for urgent risk, fraud, unlawful conduct, or system threats.

You may stop using LESRUN or delete your account at any time. Sections that by nature should survive—including ownership, lawful retention, disclaimers, liability, and dispute provisions—continue after termination.

13. Third-party services

LESRUN relies on services such as Supabase, Mapbox, Google, Apple, operating systems, networks, and app stores. Their independent terms and privacy policies may apply. LESRUN is not responsible for third-party services outside its reasonable control, but this does not limit responsibilities LESRUN has for selecting and managing its own processors under applicable data-protection law.

14. Disclaimers

To the fullest extent permitted by law, LESRUN is provided “as is” and “as available.” GPS, maps, pace, steps, route lines, territory boundaries, safety information, user identity, and community content may be incomplete, delayed, or inaccurate. LESRUN does not warrant that the service will be uninterrupted, error-free, secure against every threat, or suitable for a particular fitness, navigation, medical, or commercial purpose.

Nothing in these Terms excludes statutory guarantees, consumer rights, or duties that cannot legally be excluded.

15. Limitation of liability

To the fullest extent permitted by law, LESRUN will not be liable for indirect, incidental, special, punitive, or consequential loss, or loss of profits, opportunity, reputation, virtual progress, or data, arising from use of the service. For claims that may lawfully be limited, LESRUN’s aggregate liability will not exceed the greater of amounts you paid LESRUN during the 12 months before the claim or KES 10,000.

This limitation does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence where liability cannot be excluded, violation of non-waivable consumer rights, or any other liability that applicable law forbids limiting.

16. Responsibility for misuse

You are responsible for reasonably foreseeable losses, claims, or costs caused by your unlawful use of LESRUN, infringement of another person’s rights, or material breach of these Terms. LESRUN remains responsible for its own acts and obligations as required by law.

17. Changes to LESRUN or these Terms

We may update LESRUN and these Terms for security, legal, operational, or feature reasons. Material changes will be communicated through the app, website, or account contact where appropriate. If you do not accept revised Terms, stop using and delete your account before they take effect. Changes do not retroactively remove rights already accrued.

18. Governing law and disputes

These Terms are governed by the laws of Kenya, without excluding mandatory consumer or privacy protections that apply where you live. Before filing a claim, contact support@lesrun.com with a concise description and requested resolution so both sides can attempt good-faith resolution for 30 days. If unresolved, courts of competent jurisdiction in Nairobi, Kenya may hear the dispute, unless mandatory law gives you the right to bring it elsewhere.

19. General terms and contact

If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains effective. Failure to enforce a provision is not a waiver. You may not transfer your account or this agreement without permission; LESRUN may transfer the agreement as part of a legitimate reorganisation or service transfer with appropriate notice. These Terms, the Privacy Policy, and any applicable official promotion rules form the agreement about LESRUN.
